“BEAT YOUR BUCKET LIST” PROMOTION
- Information on how to enter and the prize forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
- Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st
- Promotion commences on Monday 21 February 2022 at 9:00am (AEDST) and entries must be received by 11:59pm AEDST on Monday 21 March 2022 (Promotional Period).
- To enter, individuals must during the Promotional Period:
access the ‘Beat Your Bucket List’ filter (Application) on the South African Tourism Facebook page on https://www.facebook.com/southafricantourismAU (Facebook Page)
using the filters, follow the prompts to put themselves in the picture fulfilling their bucket list with the experiences available in South Africa (Experiences), and share to their personal Facebook platform by tagging South Africa Tourism and #BeatYourBucketList
- Participants can enter as many times as they like.
- If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
- The Promoter reserves the right, at any time, to verify the validity of entries, and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- Incomplete, indecipherable or illegible entries will be deemed invalid.
- The Promoter reserves the right, at any time, to invalidate any entries which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or entries that have been submitted through the use of multiple identities, email addresses or accounts, including but not limited to social networking accounts.
- This is a game of skill and chance plays no part in determining the winner. At the end of the Promotional Period, each entry will be individually judged based on its creativity and its interpretation of 'Beat Your Bucket List'. The Promoter’s decision is final and no correspondence will be entered into. The winner will be notified in writing via their social media platform.
- The best valid entry, as determined by the judges, will win a trip for themselves and one (1) companion (aged 18 years or over) to South Africa, valued at up to AU$15,000 depending on date and point of departure. Prize includes the below for two (2) adults:
return economy airfares from the winner's nearest Australian capital city to Johannesburg, South Africa and any domestic flights needed within South Africa;
all accommodation, transfers and breakfast where available at accommodations; and
selected Experiences in no particular order (to be determined by the Promoter in its sole discretion) including a wildlife safari and a “Bucket List” experience featured in the entrant’s competition entry.
- Experiences may be appointed by the Promoter depending on availability and feasibility at the time of the trip, to be determined by the Promoter in its sole discretion.
- The Promoter will design the trip itinerary to include Experiences and reserves the right to choose the locations for each Experience depending on availability at the time of the trip. The Promoter also reserves the right to modify the Experiences that form part of the itinerary depending on availability and feasibility at the time of booking.
- The trip duration will be between seven (7) and ten (10) days, to be determined by the Promoter in its sole discretion.
- Spending money, additional meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. The winner and companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. The prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.
- The winner and companion acknowledge that some of the Experiences involve dangerous activities that may result in injury or death, and participate at their own risk. The winner and companion must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Promoter and Experience organisers as determined by them in their absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Experience; (c) not be under the influence of drugs or alcohol; (d) comply with all directions of the Promoter and Experience organisers at all times; and (e) wear all safety and other equipment required. The Promoter and Experience organisers, in their absolute discretion, at all times reserve the right to: (a) prevent any winner or companion from participating in the Experience if, at any time, they reasonably believe that the winner or companion poses a safety risk or for any other reason; and/or (b) cancel the Experience if the conditions are deemed dangerous. If an Experience is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered.
- Any ancillary costs associated with redeeming any voucher as part of an Experience is not included. Any unused balance of voucher as part of an Experience will not be awarded as cash. Redemption of any voucher as part of an Experience is subject to any terms and conditions of the issuer including those specified on the voucher.
- Any tickets awarded as part of an Experience are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and Experience organisers hereby expressly reserve the right to eject the winner (and/or companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
- As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
- Prize must be taken by 31/12/2023 and is subject to booking, flight and Experience availability. Prize cannot be taken during Australian school holidays, public holidays or other peak period. Peak periods include Australian school holidays and mid-December to mid-January.
- In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify the prize, as appropriate.
- If for any reason the winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
- The prize is not transferable or exchangeable and cannot be taken as cash.
- All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
- Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are the winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
- Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
- Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
- Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f); use of the prize.
- The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
- Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at facebook.com/terms.php.
- This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. Entrants understand that they are providing their information to the Promoter and not to Facebook or Instagram. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions.
